General Information
A class action occurs when a plaintiff, on behalf of a larger class of plaintiffs with the same interests, commences legal proceedings against a defendant(s). That plaintiff is called the class representative.
A class representative is the individual person(s) named to litigate on behalf of the entire class. Not only must members of the class have the same interests as the class representative, but the action itself can only be certified by the court as a class action if the ultimate determination of the claims of the entire group would be more efficient than proceeding with numerous, similar individual lawsuits.
If a class action is certified, notice must be provided to all potential members of the class who may then choose to remove themselves from the class action.
