Class Actions > Royal Fine Cars vs. Ford Motor Company
Together with Colin Stevenson and Harvin Pitch, Levine Sherkin Boussidan commenced a class action in Ontario against Ford Motor Company and Ford Motor Company of Canada Limited (“Ford”).
This class action alleges that Ford manufactured in the 1983 through 1995 model years Ford, Lincoln and/or Mercury motor vehicles with a distributor mounted thick film ignition (“TFI”) module. The TFI module, used to regulate the current that creates the ignition spark, was mounted on the distributor above the engine block and was an integral part of the solid state ignition system that Ford used in most of their vehicles.
The class action alleges that as the TFI module was mounted on the distributors, it was susceptible to malfunctions due to overheating, and as such posed a real substantial danger to the health and safety to the members of the class and other occupants of those motor vehicles.
The claim against Ford in respect of certain TFI modules on these motor vehicles was certified as a class action by the order dated May 3, 2005 of the Honourable Madam Justice E. Macdonald.

All parties have agreed that the central issue of Ford's alleged negligence will be argued in the concurrent British Columbia action of Barbara Reid v. Ford Motor Company, which is scheduled to commence trial in Vancouver in November 2005.
