| Together with Colin Stevenson and Harvin Pitch, Levine Sherkin Boussidan commenced two class actions in Ontario against Sony Corporation and Sony of Canada Ltd. |
| The first class action brought against Sony Corporation is for damages resulting from the sale of allegedly defective DVD players. Brand models include the S330, S360, S530D, S550D, S560D and S570D. Consumers have complained that they find that the DVD player malfunctions after the expiry of the warranty period. Often the screen freezes and a “no disc” error is displayed and the DVD player simply refuses to function. |
The second class action brought against Sony of Canada Ltd. is for damages with respect to the sale of the Sony Playstation 2 (“PS2”). The PS2 was rushed into production and has allegedly experienced severe difficulties. There are numerous consumer complaints about this product. Many of these complaints occur beyond the warranty period. There is an inherent defect which causes the screen to “freeze”, the reading of a “no disc” error message and finally, the collapse of the
system itself. |

| It is anticipated that the Canadian action will proceed to certification at some point in the near future. |
